Children and Justice During and in the Aftermath of Armed Conflict

This working paper for the Office of the Special Representative of the Secretary-General for Children and Armed Conflict was co-authored by Carolyn Hamilton of Coram International.

The Working Paper on Children and Justice During and in the Aftermath of Armed Conflict is the third in a series issued by the Office of the Special Representative of the Secretary-General for Children and Armed Conflict, following The Six Grave Violations against Children during Armed Conflict: the Legal Foundation (2009) and The Rights and Guarantees of Internally Displaced Children in Armed Conflict (2010).

The purpose of this 2011 paper was to bring more conceptual clarity to the issue of children and justice in times of armed conflict by examining relevant legal provisions, academic discussions, and a number of case studies. The latter include administrative detention in Afghanistan, security detention in Iraq, the Gacaca Courts after the Rwandan genocide, Guantanamo and the precedent of Omar Khadr, and Palestinian children in Israeli detention.
